Just to note a few things.
If you’re drunk or drugged (which I guess can mean anything) you cannot consent. Claire would’ve totally been guilty of rape. And you are too if your girl had a drink that night. Though I guess if you’re both drunk, you just raped each other.
Consent can be NONVERBAL such as the tilt of the head or moving closer, which pretty much nullifies this whole thing, because, again, it comes down to how we want to interpret it when she moved her body in a certain way. After all, she doesn’t have to say “no”, and doesn’t have to say “yes” either.
